1. Introduction

These Terms and Conditions govern your subscription to Restoracio services provided by Omniscient Sàrl. By subscribing to our services, you agree to be bound by these terms. Please read them carefully before completing your purchase.

2. Subscription Terms

When you subscribe to any of our plans (Starter, Core, or Elite), you agree to the following:

  • Your subscription is valid for a period of one (1) year from the date of purchase.
  • Payment is due in full at the time of subscription and is processed securely through Stripe.
  • After the initial year, your subscription will automatically renew unless you cancel before the renewal date.
  • All prices are displayed in the currency shown and include applicable taxes where required by law.

3. Right of Withdrawal (14-Day Money-Back Guarantee)

In accordance with consumer protection laws, you have the right to withdraw from your subscription within fourteen (14) calendar days from the date of purchase without giving any reason. To exercise your right of withdrawal:

  • You must inform us of your decision to withdraw by contacting us via email at contact@omniscient.swiss or by phone at +41 79 580 78 99 within the 14-day period.
  • We will process your full refund within 14 days of receiving your withdrawal request.
  • After the 14-day withdrawal period has expired, you are committed to the full one-year subscription term, and no refunds will be issued for early cancellation.

Important: If you begin using our services during the 14-day withdrawal period and then decide to withdraw, you may be charged a proportional amount for the services used up to the point of withdrawal.

4. Payment Terms

Payment processing is handled securely through Stripe, our payment processor:

  • All payments are processed in real-time and require valid payment method information.
  • You authorize Stripe to charge your payment method for the subscription amount.
  • In case of payment failure, we reserve the right to suspend your account until payment is successfully processed.

5. Service Description and Limitations

We commit to providing the services as described in your selected plan (Starter, Core, or Elite). However, you acknowledge and agree that: We will provide only the features and services explicitly listed in your chosen subscription plan. Any requests for features, services, or support beyond what is described in your plan are not covered by your subscription. We make no guarantees regarding specific business outcomes, such as increased revenue, customer acquisition, or website traffic. Our services are provided on an 'as is' and 'as available' basis. While we strive for 99.9% uptime, we do not guarantee uninterrupted or error-free service.

6. Limitation of Liability

To the maximum extent permitted by applicable law:

  • Omniscient Sàrl shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use or inability to use our services.
  • Our total liability for any claims arising from your subscription shall not exceed the amount you paid for the subscription.
  • We are not responsible for any losses resulting from unauthorized access to your account due to your failure to maintain the confidentiality of your login credentials.
  • We are not liable for any third-party services, integrations, or content accessed through our platform.

7. Cancellation and Renewal

You may cancel your subscription at any time by contacting our support team. However, please note that: Cancellations made after the 14-day withdrawal period do not entitle you to a refund for the remaining subscription period. Your access to services will continue until the end of your current subscription period. If you do not cancel before your renewal date, your subscription will automatically renew for another year at the then-current subscription price.

8. Modifications to Terms

We reserve the right to modify these Terms and Conditions at any time. We will notify you of any material changes via email at least 30 days before they take effect. Your continued use of our services after such modifications constitutes your acceptance of the updated terms.

9. Governing Law and Jurisdiction

These Terms and Conditions are governed by and construed in accordance with the laws of Switzerland. Any disputes arising from these terms or your use of our services shall be subject to the exclusive jurisdiction of the courts of Switzerland.
